this is a Treaty on Rights and Mutual Obligations
two sides “User-Representative”,
arising when purchasing and using the “Super Torque” Pulse Module.
Article 1.
The user has the right:
1.1. receive a receipt when paying for the “Super Torque” Pulse Module;
1.2. receive the “Super Torque” Pulse Module in good condition, namely, be personally present when checking the serviceability of the “Super Torque” Pulse Module;
note:
verification is carried out after payment and unpacking (if packaging is available),
before connecting and activating the Manufacturer’s Warranty;
1.3. receive a full package of services at the FPDtech Service Center of the Representative for all points of the FPDtech Registration Form in accordance with the requirements of the FPDtech Technical Regulations;
1.4. receive full explanations from FPDtech Service Center specialists when carrying out the work necessary to completely fill out all points of the FPDtech Registration Form;
1.5. receive full information about the “Preferential Price” and “Agency Agreement” programs;
1.6. receive notices/notifications about events and promotions conducted by the FPDtech Representative, new services or changes in program conditions;
1.7. to return the “Super Torque” Pulse Module within the return period, which is determined by the current local legislation (14 days in the Republic of Kazakhstan);
note:
when returning the “Super Torque” Pulse Module, a refund to the User of the funds actually spent by the User to pay for the “Super Torque” Pulse Module in full is possible and is carried out only after a full service check and assessment of compliance with the criteria “Serviceability of the “Super Torque” Pulse Module” and “Compliance the presentation of the “Super Torque” Pulse Module and complete completion of the Return Form, provided that it is in good working order and meets the criteria “Serviceability of the “Super Torque” Pulse Module” and “Compliance with the presentation of the “Super Torque” Pulse Module”, which do not include removable contamination of the housing and switching;
note:
the obvious impossibility of re-selling at a discount to the next User the returned “Super Torque” Pulse Module is an indisputable basis for the Representative for non-refunding the amount of actual payment made by the User when purchasing the “Super Torque” Pulse Module;
1.8. in case of inoperability of the “Super Torque” Pulse Module during the period of fulfillment of the Manufacturer’s Warranty obligations, a free replacement and free installation/connection of a new “Super Torque” Pulse Module during the entire period of validity of the Manufacturer’s Warranty obligations;
in this case, the inoperability of the “Super Torque” Pulse Module cancels
the need to comply with the criteria “Serviceability of the “Super Torque” Pulse Module” and “Compliance with the presentation of the “Super Torque” Pulse Module”;
note 1:
the period for fulfilling the Manufacturer’s Warranty obligations may be changed to increase the period in cases where additional bonus conditions are provided, consent to which is voluntary, at the discretion of the User;
note 2:
when replacing the “Super Torque” Pulse Module under warranty, the period for fulfilling the Manufacturer’s Warranty obligations begins anew from the date of replacement;
the period for fulfilling the Manufacturer’s Warranty obligations in this case cannot be less than originally stated;
the serial number of the new “Super Torque” Pulse Module must be sent through direct communication between the User and the Manufacturer on the Manufacturer’s website www.fpdtech.kz to confirm and activate the new validity period of the Manufacturer’s Warranty;
note 3:
bonus conditions include, inter alia, the opportunity for the User to pay for an extension of the period for fulfilling the Manufacturer’s Warranty obligations through direct communication with the Manufacturer on the Manufacturer’s website www.fpdtech.kz;
the cost of the service for extending the Manufacturer’s Warranty period is, for one year, 10% of the official full cost of the “Super Torque” Pulse Module, excluding discounts under the “Preferential Price” program;
note 4:
the period for fulfilling the Manufacturer’s Warranty Obligations may be changed by the Manufacturer without the participation of the Representative to reduce the period in cases of failure to comply with the conditions for activating the Manufacturer’s Warranty Obligations.
note 5:
The Manufacturer’s warranty obligations relate exclusively to the serviceability of the “Super Torque” Pulse Module.
The standard period of the Manufacturer’s Warranty is 12 (twelve) months from the date of activation of the Manufacturer’s Warranty;
1.9. receive a mandatory paper copy of the fully completed FPDtech Registration Form and a paper copy of the User Agreement, certified by the signatures of both Parties;
1.10. receive from the Representative in one payment 18% of the amount paid for the purchase of the “Super Torque” Pulse Module if the conditions of the “Preferential Price” program are met immediately after completely filling out the Registration Form.
Article 2.
Official Representative of FPDtech
(hereinafter referred to as the Representative) undertakes:
2.1. issue a receipt confirming payment for the “Super Torque” Pulse Module;
2.2. after payment, check the serviceability and compliance of the presentation of the “Super Torque” Pulse Module in the presence of the User;
issue to the User a “Super Torque” Pulse Module that meets the criteria “Serviceability of the “Super Torque” Pulse Module” and “Compliance with the presentation of the “Super Torque” Pulse Module”;
2.3. ensure full implementation of services in the FPDtech Service Center of the Representative on all points of the FPDtech Registration Form in accordance with the requirements of the FPDtech Technical Regulations;
2.4. give full explanations when carrying out the work necessary to completely fill out all points of the FPDtech Registration Form,
including, if necessary, provide assistance to the User during direct communication between the User and the Manufacturer on the Manufacturer’s website www.fpdtech.kz;
2.5. give full explanations about the “Preferential Price” and “Agency Agreement” programs;
2.6. send notices/notifications about events and promotions conducted by the FPDtech Representative, new services or changes in program conditions if the User has confirmed and given the User’s Consent in writing or electronically to the service of receiving notices/notifications from the FPDtech Representative;
2.7. ensure the fulfillment of the User’s unconditional right to return the “Super Torque” Pulse Module within the return period, which is determined by the current local legislation (14 days in the Republic of Kazakhstan);
note:
when returning the “Super Torque” Pulse Module, a refund to the User of the funds actually spent by the User to pay for the “Super Torque” Pulse Module in full is possible and is carried out only after a full service check and assessment of compliance with the criteria “Serviceability of the “Super Torque” Pulse Module” and “Compliance the presentation of the “Super Torque” Pulse Module and complete completion of the Return Form, provided that it is in good working order and meets the criteria “Serviceability of the “Super Torque” Pulse Module” and “Compliance with the presentation of the “Super Torque” Pulse Module”, which do not include removable contamination of the housing and switching;
2.8. ensure the fulfillment of the User’s unconditional right in the event of inoperability of the Super Torque Pulse Module during the period of fulfillment of the Manufacturer’s Warranty obligations for free replacement and free installation/connection of a new Super Torque Pulse Module during the entire period of validity of the Manufacturer’s Warranty obligations;
in this case, the inoperability of the “Super Torque” Pulse Module cancels
the need to meet the criteria “Serviceability and compliance with the presentation of the Super Torque Pulse Module”;
note 1:
when replacing the “Super Torque” Pulse Module under warranty, the period for fulfilling the Manufacturer’s Warranty obligations begins anew from the date of replacement;
the period for fulfilling the Manufacturer’s Warranty obligations in this case cannot be less than originally stated;
the serial number of the new “Super Torque” Pulse Module must be sent through direct communication between the User and the Manufacturer on the Manufacturer’s website www.fpdtech.kz to confirm and activate the new validity period of the Manufacturer’s Warranty;

the period for fulfilling the Manufacturer’s Warranty obligations may be changed to increase the period in cases where additional bonus conditions are provided, consent to which is voluntary, at the discretion of the User;

bonus conditions include, inter alia, the opportunity for the User to pay for an extension of the period for fulfilling the Manufacturer’s Warranty obligations through direct communication with the Manufacturer on the Manufacturer’s website www.fpdtech.kz;
the cost of the service for extending the Manufacturer’s Warranty period is, for one year, 10% of the official full cost of the “Super Torque” Pulse Module, excluding discounts under the “Preferential Price” program;
note 4:
the period for fulfilling the Manufacturer’s Warranty obligations without the participation of the Representative may be changed by the Manufacturer to reduce the period in cases of failure to comply with the conditions for activating the Manufacturer’s Warranty obligations;
note 5:
The Manufacturer’s warranty obligations relate exclusively to the serviceability of the “Super Torque” Pulse Module.
The standard period of the Manufacturer’s Warranty is 12 (twelve) months from the date of activation of the Manufacturer’s Warranty. 2.9. in the event of a change in the User’s vehicle during the validity of the Manufacturer’s Warranty obligations, reinstall the “Super Torque” Pulse Module on another User’s vehicle at a discounted price established at the discretion of the Representative, but not exceeding 10% of the official full cost of the “Super Torque” Pulse Module, without accounting for discounts under the “Preferential Price” program; 2.10. in case of change of the User’s vehicle after the expiration of the Manufacturer’s Warranty obligations, reinstall the “Super Torque” Pulse Module on another User’s vehicle at a discounted price established at the discretion of the Representative, but not exceeding 20% of the official full cost of the “Super Torque” Pulse Module, excluding discounts under the “Preferential Price” program;
2.11. not to transfer to third parties and/or publicly disclose, orally or in writing, the User’s personal information, namely the Last Name, First Name, contact phone number of the User, state registration number of the User’s vehicle on which the “Super Torque” Pulse Module is installed;
2.12. issue without fail a paper copy of the fully completed FPDtech Registration Form and a paper copy of the User Agreement, certified by the signatures of both Parties.
2.13. issue to the User in one payment 18% of the amount paid for the purchase of the “Super Torque” Pulse Module upon fulfilling the conditions of the “Preferential Price” program immediately after completely filling out the Registration Form.
Article 3.
The user undertakes:
3.1. do not use the “Super Torque” Pulse Module for other purposes;
note:
the purpose of the “Super Torque” Pulse Module models by vehicle class and mains voltage of the vehicle of this class are published on the Manufacturer’s website www.fpdtech.kz;
note:
non-intended use includes, including independent, that is, without the participation of an FPDtech Service Center specialist, installation/connection of the “Super Torque” Pulse Module and installation/connection of the “Super Torque” Pulse Module model with the specified vehicle class and parameters voltage of the electrical network of a vehicle of a given class on a vehicle of another class and other parameters of the voltage of the electrical network of the vehicle;
3.2 do not transfer the “Super Torque” Pulse Module to third parties for use other than its intended purpose;
3.3. provide reliable data when filling out all points of the FPDtech Registration Form;
note:
in case of changes in the User’s data, namely the Last Name, First Name, contact telephone number of the User, change of Vehicle, promptly, that is, no later than the expiration of the Manufacturer’s Warranty obligations, notify about the changes through direct communication with the Manufacturer on the Manufacturer’s website www.fpdtech.kz;
note:
identification and/or confirmation of the fact of providing false data, unintentional or intentional, releases the Manufacturer from fulfilling the Manufacturer’s Warranty obligations and, at the same time, releases the Representative from fulfilling the joint and several Warranty obligations of the Representative;
3.4. provide the Manufacturer with an unconditional, by default, right to publish the data received when filling out the FPDtech Registration Form in accordance with the requirements of the FPDtech Technical Regulations in cases where the publication does not contain personal information, namely the Last Name, First Name, contact phone number of the User, state registration number of the User’s vehicle , on which the “Super Torque” Pulse Module is installed;
3.5. when changing a vehicle on which the “Super Torque” Pulse Module is installed, reinstall the “Super Torque” Pulse Module on another vehicle in the FPDtech Service Center of the Representative to activate the Manufacturer’s Warranty obligations;
note:
reinstallation on another vehicle in the FPDtech Service Center of the Representative is carried out at a discounted price, stipulated by clauses 2.9. and 2.10. Article 2 of this Agreement;
3.6. read all clauses of the User Agreement;
3.7. confirm your agreement with the terms of all clauses of all articles of this User Agreement with the User’s personal signature with a transcript, that is, write your Last Name and First Name in your own hand;
3.8. consider, in cases where it is impossible to put a personal signature with a transcript, the fact of payment for the “Super Torque” Pulse Module as confirmation equal to the User’s personal signature in writing, compliance with clauses 3.6. and 3.7. of this User Agreement and the User’s consent to comply with the terms of all clauses of all articles of this User Agreement in full;
3.9. bear full personal financial responsibility for the good operating condition of your own vehicle, including for the compliance of all components, assemblies and assemblies of your own vehicle with the technical specifications and requirements of the Vehicle Manufacturer and the absence of non-certified non-standard devices before installing the “Super Torque” Pulse Module on the User’s vehicle.
Article 4.
The representative has the right:
4.1. following the terms of the Partnership Agreement with the Official Manufacturer of FPDtech, refuse to sell the “Super Torque” Pulse Module to the User in cases where the User’s vehicle does not meet the criteria for a serviceable vehicle in accordance with the requirements of the FPDtech Technical Regulations;
4.2. reschedule the work in cases where the equipment necessary to perform work on all points of the FPDtech Registration Form in accordance with the requirements of the FPDtech Technical Regulations is undergoing repair and maintenance;
4.3. when returning within the return period (in the Republic of Kazakhstan 14 days) a serviceable “Super Torque” Pulse Module that does not fully meet the criteria “Serviceability of the “Super Torque” Pulse Module” and “Compliance with the presentation of the “Super Torque” Pulse Module”, independently determine the return amount , guided by the possibility or impossibility of re-selling at a discount to the next User;
note:
the obvious impossibility of resale at a discount to the next User is an indisputable basis for non-refund of the amount of actual payment made by the User for the purchase of the “Super Torque” Pulse Module;
4.4. to develop and implement their own preferential user programs and promotions in order to attract new Users, provided that these programs and promotions do not contradict all clauses of all articles of this User Agreement and the Partnership Agreement with the Official Manufacturer FPDtech;
4.5. offer your own services and goods that are not related to the fulfillment of the terms of the Partnership Agreement with the Official Manufacturer FPDtech;
the obvious impossibility of resale at a discount to the next User is an indisputable basis for non-refund of the amount of actual payment made by the User for the purchase of the “Super Torque” Pulse Module;
4.4. to develop and implement their own preferential user programs and promotions in order to attract new Users, provided that these programs and promotions do not contradict all clauses of all articles of this User Agreement and the Partnership Agreement with the Official Manufacturer FPDtech;
4.5. offer your own services and goods that are not related to the fulfillment of the terms of the Partnership Agreement with the Official Manufacturer FPDtech;
Article 5.
Functionality check
Pulse Module “Super Torque”
the serviceability of the “Super Torque” Pulse Module is checked
in the following sequence:
5.1. turn on the vehicle ignition – the LED indicator on the Module cover lights up;
5.2. turn off the ignition, the LED indicator on the Module cover goes out;
5.3. remove the fuse from the housing;
5.4. Set the Multimeter to “DC milliamps” mode;
5.5. Connect the Multimeter probes to the contact sockets in the Fuse body;
5.6. turn on the vehicle ignition – the LED indicator on the Module cover lights up;
5.7. current consumption on the Multimeter display “10-100mA” or “-10-100mA” means that
The module is OK;
5.8. turn off the ignition;
5.9. connect the fuse, the test is completed.
In cases where, when the ignition is turned on, the LED INDICATOR on the Module cover DOES NOT LIGHT UP, checking the serviceability of the “Super Torque” Pulse Module is carried out in the following sequence:
5.10. turn off the ignition;
5.11. unclip the Module from the switching and disconnect the switching from the vehicle’s power supply;
5.12. remove the Fuse from the housing to carry out an instrumental check of the serviceability of the Fuse; If the fuse is good, then
5.13. On the Multimeter, set the “diode ringing” mode;
5.14. snap the switch onto the Module body;
5.15. connect the red wire/“+” commutation to the “-” probe of the Multimeter, connect the black wire/“-” commutation to the “+” probe of the Multimeter;
5.16. in the case when the Multimeter display shows “0.5-0.8V” the Module is CORRECT, but belongs to the “Manufacturer’s defect” category and is subject to replacement under the Manufacturer’s Warranty, the test is completed.
In some cases, when, when the ignition is turned on, the LED INDICATOR on the Module cover DOES NOT LIGHT UP and the instrument check of the serviceability of the Fuse reveals a faulty Fuse,
recommended:
replace the Fuse with a serviceable one and connect it to the contact sockets in the Fuse body;
If, when the ignition is turned on, the LED INDICATOR on the Module cover LIGHTS UP, then the Module is CORRECT, the test is completed.
If, after replacing a faulty Fuse, when the ignition is turned on, the LED indicator on the Module cover DOES NOT LIGHT UP, checking the serviceability of the Module continues in the following order:
5.17. On the Multimeter, set the “diode ringing” mode;
5.18. unclip the Module from the switching and disconnect the switching from the vehicle’s power supply;
5.19. snap the switch onto the Module body;
5.20. connect the red wire/“+” commutation to the “-” probe of the Multimeter, connect the black wire/“-” commutation to the “+” probe of the Multimeter;
5.21. in the case when the Multimeter display shows “0.5-0.8V”, the Module is CORRECT, but belongs to the “Manufacturer’s defect” category and must be replaced under the Manufacturer’s Warranty, the test is completed;
5.22. in the case when the Multimeter display shows “0” or “1” or another designation of “infinite voltage drop”, this means that the Module is OUT OF SERVICE due to INCORRECT polarity or an attempt to install the Module on a vehicle of a different category, which led to an IRREVERSIBLE MALFUNCTION of the Module.
Manufacturer Notice:
such a case, namely, instrument-installed confirmation of incorrect connection of the Module commutation due to non-compliance with the polarity, which led to an irreversible malfunction of the Module, cannot be classified as a “Manufacturer’s defect”, and is a failure to comply, unintentional or intentional, with paragraph 3.1. and the basis for the Representative to not return the User’s funds actually spent on the purchase of the “Super Torque” Pulse Module due to failure to fulfill the User’s obligations.
Article 6.
Criteria “Conformity of presentation
Pulse Module “Super Torque”:
6.1. absence of visible signs of damage to the case, namely chips, dents, scratches, traces of thermal, thermoelectric effects, difficult to remove and/or non-removable traces of technical fluids, traces of chemical and electrochemical effects, absence of visible mechanical damage to the switching unit on the case cover;
6.2. switching damage includes violation of the insulation of switching wires, mechanical fractures, traces of thermal, thermoelectric effects, difficult to remove and/or non-removable traces of technical fluids, traces of chemical and electrochemical effects, mechanical damage to the external fuse block;
6.3. damaged switching cannot be repaired or returned;
the amount of deduction for damaged commutation is announced by the Representative during the sale and does not exceed 10% of the official full cost of the “Super Torque” Pulse Module, excluding discounts under the “Preferential Price” program;
Article 7.
Dispute Resolution
between the parties “User” and “Representative”.
6.1. the priority resolution of the dispute is the settlement of disagreements between the Parties in pre-trial proceedings;
6.2. possible claims on the part of the User in cases of detection of malfunctions of the User’s vehicle that appeared after connecting the “Super Torque” Pulse Module, as well as in cases where, in the User’s opinion, the effectiveness of the “Super Torque” Pulse Module has not been confirmed in practice on the User’s vehicle, are accepted for consideration by the Representative only in accordance with the Protocol for Consideration of Claims;
note:
The Claims Review Protocol includes a list of necessary documents on the part of the User, namely: the original User Agreement, the original receipt, the original Registration Form, the Expert Opinion of a certified institution on the current operational condition of all systems of the User’s vehicle and the compliance of all systems of the User’s vehicle with the requirements of the Technical Regulations of the Vehicle Manufacturer the User before the date of installation of the “Super Torque” Pulse Module on the User’s Vehicle;
note:
An expert opinion from a certified institution on the current operational condition of all systems of the User’s vehicle and the compliance of all systems of the User’s vehicle with the requirements of the Technical Regulations of the Manufacturer of the User’s Vehicle before the date of installation of the “Super Torque” Pulse Module on the User’s vehicle may be the only basis for comparison and identification of differences in the operation of the User’s vehicle systems before and after installation of the Module by conducting comprehensive comparative tests with the participation of independent experts.
Article 8.
Contract time.
8.1. The validity period of this User Agreement is 12 (twelve) months.
8.2. The validity period of this User Agreement does not include a possible extension of the period for fulfilling the Manufacturer’s Warranty obligations through direct communication between the User and the Manufacturer on the Manufacturer’s website www.fpdtech.kz in accordance with Note 3. Article 1 of this User Agreement.
8.3. This User Agreement comes into force upon signing by both Parties.
